1. DEFINITIONS

The definitions below have the same meaning whether used in the singular or the plural. 

 

1.1. “LE CARRE DES AS” or “we”: designates the company LE CARRE DES AS.

1.3 “Tourist package”: Constitutes a tourist package (within the meaning of article L 211-2 of the Tourism Code), the service:
• resulting from the prior combination of at least two operations relating respectively to transport, accommodation or other tourist services not ancillary to transport or accommodation and representing a significant part of the package,
• exceeding twenty-four hours or including an overnight stay,
• sold or offered for sale at an all-inclusive price.

1.4 "Partner" or "Service Provider" means all service providers including, in particular, rail carriers including SNCF, maritime carriers, airlines, hotels, tour operators, car rental companies, insurance.

1.5 "Service" means any service offered on the site, such as the supply of air tickets, accommodation services, car rental, the supply of tourist packages or any other service.

1.6 "User" or "you" or the "customer": refers to any user of the site who browses, becomes aware of, reserves, orders and/or purchases one or more Services offered on the Site as well as any person benefiting from a reserved service by a User.

2. CAPACITY
The User acknowledges having the capacity to contract under the conditions described, ie to be at least 18 years old, to be legally capable of contracting and not to be under guardianship or curatorship. The User guarantees the truthfulness and accuracy of the information provided by him on the LE CARRE DES AS website. 
Warning: Reminder of the terms of article L 313-1 of the Penal Code: "The fraud is the fact, either by the use of a false name or a false quality, or by the abuse of a true capacity, either by the use of fraudulent maneuvers to deceive a natural or legal person and thus to determine him, to his prejudice or to the prejudice of a third party, to remit funds, securities or any property, to provide a service or to consent to an act effecting obligation or discharge. Fraud is punishable by five years' imprisonment and a fine of €375,000”.

3.ORDER/RESERVATION

3.1 Ordering
You can book by phone at 06.14.55.12.05, by mail contact@lecarredesas.fr  or at the agency Le Carré des AS - 137 impasse des Alpes - 38260 Marcilloles. This order is governed by these general conditions of sale detailing the content of your order.
LE CARRE DES AS will send you by return e-mail the confirmation of the order containing the essential elements thereof such as the identification of the supplier of the product or service reserved, the price, the quantity, the date of travel. Thus, in application of the provisions of articles L 211-1 II and R 211-3-1 of the Tourism Code, the order confirmation that will be sent to you will attest to the establishment, by electronic means, of the sales contract between LE CARRE DES AS and yourself. 

In the absence of a return confirmation e-mail from LE CARRE DES AS, the reservation has not been taken into account. It is therefore up to you in all cases to ensure that you have received the confirmation e-mail. Otherwise contact: Customer service on 06 42 88 27 34. 

In addition to the elements available on the LE CARRE DES AS website, you will find at the end of these general conditions of sale the provisions of the Tourism Code which apply to activities relating to the organization and sale of travel or stays ( reproduction of articles R 211-3 to R 211-11 of the Tourism Code). 

Your order is governed by the conditions of sale which are in force at the time of placing the said order. The information contained on the LE CARRE DES AS website, the estimate, the proposal, constitute the prior information referred to in article L 211-8 of the Tourism Code. You acknowledge having read and accepted these conditions of sale in your name and on your behalf but also in the name and on behalf of all the beneficiaries of the order, when placing it._cc781905-5cde-3194- bb3b-136bad5cf58d_
You also acknowledge the need to have equipment or technical means allowing you to print the information that LE CARRE DES AS sends you and relating to your order (printer, etc.). 

3.2 Products ordered
In the event of an order for several products for a single trip (for example plane + hotel + car rental), it is your responsibility to check the consistency of the different products chosen: dates and times of arrival and departure, number of nights and/or or days. When ordering several transport tickets for the same trip, check the time difference, connection times and distances between different stations, terminals or airports in the same city. 

3.3 Availability
Most of the products offered on this site are available and bookable. If a product is unavailable, this will be indicated to you during your request. During school holidays or for close departures, certain products such as tour operator packages are not immediately available and bookable and must be the subject of a request (request) from the Service Providers._cc781905-5cde-3194- bb3b-136bad5cf58d_

Your credit card number must be provided to us as a guarantee of your request and an authorization request for the amount to be paid will be sent to your bank. You will only be charged upon confirmation of your trip, which generally occurs within 72 hours of the date of your reservation request. 3.4 Amendment
Any request to modify your order must be made by telephone to LE CARRE DES AS at the following number 06.14.55.12.05, or by email contact@lecarredesas.fr. LE CARRE DES AS will send you by return, by e-mail, for acceptance the modification request and the amount of the related costs. 

After your acceptance of the modification and the payment of the corresponding fees, you will receive by e-mail a confirmation of the modification. In the absence of a confirmation email from LE CARRE DES AS, the modification has not been taken into account. It is therefore up to you in all cases to ensure that you have received the confirmation email. 

3.5 Cancellation
Cancellation generates cancellation fees at your expense and varies according to the date of cancellation and the type of services ordered and which are specified in these conditions of sale. 

Any request to cancel your order must be made in writing to LE CARRE DES AS at the following address:  contact@lecarredesas.fr. LE CARRE DES AS will send you by return, by e-mail, for acceptance the cancellation request and the amount of the related costs. 

After your acceptance of the cancellation and the payment of the corresponding costs, you will receive a confirmation of cancellation by e-mail. In the absence of a confirmation email from LE CARRE DES AS, the cancellation has not been taken into account. It is therefore up to you in all cases to ensure that you have received the confirmation e-mail. Otherwise contact us online or at 06.14.55.12.05.

4.PRICE

4.1 Price: All prices are displayed in Euros payable from France.
The total price to be paid comprising the various components of your order, the service charges mentioned below and the applicable taxes are displayed during your order confirmation. In accordance with the VAT regime on the margin of travel agents, the invoices issued by LE CARRE DES AS do not mention the VAT collected on the services sold. 

4.2 Price revision: The prices indicated are those in effect on the date of the order.
The prices have been set according to the following economic data: cost of transport linked in particular to the cost of fuel, transport costs and taxes (landing, boarding, disembarkation, security tax, ecotax, etc.), rate exchange rate applied to currencies depending on the trip or stay concerned. 

Please note: In accordance with article L211-12 of the Tourism Code, in the event of a change in these data and in particular in the amount of taxes, passenger fees and/or fuel surcharges applied by the authorities and/or airlines, these will be fully and immediately reflected in the price of all products from its date of application, including for customers already registered and having already paid for the corresponding Service. 

Currency fluctuations are also likely to lead to a revision of the price of the Services. The currencies likely to have an influence on the prices are in particular the American dollar, and the currencies of the countries in which the Hosting Services are offered.
During the 20 (twenty) days preceding the scheduled departure date, the price fixed in the contract cannot be subject to an increase. 

4.3 Service fees
Any order on the LE CARRE DES AS website entails the collection by LE CARRE DES AS of service fees, which vary according to the type of services requested and expressed per person or per file, which are added to the price of the Services ordered. In the event of cancellation, the service charge is non-refundable. 

5. PAYMENT

5.1 Methods of payment: You must make your payment by French bank card, by check or by bank transfer. 

5.2 Terms of payment: Full payment is required at the time of the order for all orders with the exception of orders for Tourist Packages (see below). The file is confirmed only when the payment is made by the customer. 

5.3 Payment for travel packages:
For package travel orders, the User may either pay cash at the time of the order (no discount is applicable) or, for orders made more than 45 (forty-five) days before departure, the User has the possibility to pay 30% (forty percent) of the amount of the order when booking and the balance of the price 45 (forty-five) days before the departure date. Failing this, it is up to the customer to pay the balance by calling 06.14.55.12.05. Thus, for orders placed less than 45 (forty-five) days before departure, the full amount of the order must be paid by the user.
Failure to pay the balance within the time limit is likely to result in the cancellation of the order by the customer, the latter remaining liable for the cancellation costs.
In any case, the delivery of a credit card number is not considered as discharge from the debt until the agreement of the payment center is obtained.

5.4 Payment of low cost airlines:
For any plane ticket order with certain so-called "Low Cost" airlines, the User's card will be debited twice, one directly by the airline for the amount of the transport ticket and the other by LE CARRE DES AS for the amount of applicable service fees. 

5.5 Default of payment / cancellation:
In the absence of full payment within the stipulated time, LE CARRE DES AS is entitled to cancel the order made by the User. Before receipt of full payment, LE CARRE DES AS is not required to issue any transport ticket, ticket or voucher. The customer is warned of the possible failure of the bank transaction during the act of online purchase. He is then invited to pay by contacting customer service. 

Failure by the User to comply with the terms of payment will be considered by LE CARRE DES AS as a cancellation requested by the User. In the event that payment proves to be irregular, incomplete or non-existent, for any reason whatsoever, the sale of the reserved services will be cancelled, the resulting costs being borne by the User._cc781905-5cde-3194-bb3b -136bad5cf58d_

Please note: in order to minimize the consequences of bank card fraud, LE CARRE DES AS reserves the right to carry out random checks and to ask the User to fax or post proof of his address, a copy of both sides of the bank card used for payment, as well as that of an identity document of the holder of the bank card and that of the passenger, before issuing a ticket.
Late payment penalties of an amount equal to the interest rate applied by the European Central Bank to its most recent refinancing operation plus 10 percentage points is automatically applicable to the amount unpaid beyond the date of payment planned. 

6. ADMINISTRATIVE AND HEALTH INFORMATION

6.1 Formalities
For non-French nationals, it is up to the User to check with the authorities concerned (Consulate, Embassy, etc.), taking into account their nationality, the various police, customs and health formalities, for their trip, including including stopovers and transits and to comply with them.

If the User and/or the persons registered by him/her were refused boarding or access to the country of destination for lack of compliance with police, health or customs formalities, the User alone will bear all penalties and/or or fines that may be imposed and resulting from non-compliance with police, health or customs regulations, as well as the consequences that may result therefrom.
Some countries require, in addition to a possible visa, that the validity of the passport be greater than 6 months after the date of return, to have a return or onward ticket and sufficient funds. 

For French nationals, since January 1, 2014, the French authorities have decided to extend the period of validity of the CNI (national identity card) for a period of 5 years (NB: this extension of validity is only valid for adults, excluding minors).
In other words:
- the new CNI issued since 01/01/2014 are valid for 15 years 
- CNIs issued in laminated form between 02/01/2004 and 31/12/2013 are automatically valid for 15 years, without any procedure to be completed
- CNI issued to minors before or after 01/01/2014 are and will be valid for 10 years only 

Insofar as this decision to extend the validity of CNIs does not entail any material modification, the French authorities have drawn up, for countries recognizing the CNI as a travel document, a standard official certificate in three languages (French, English and country of destination) which you can download from the website of the Ministry of Foreign Affairs (www.diplomatie.gouv.fr / section “Advice to travelers”). However, certain countries of destination which nevertheless accept the CNI as a travel document do not recognize this extension measure and, notwithstanding the aforementioned standard certificate, the Ministry itself strongly recommends, in order to avoid any difficulty, to favor the use of 'a valid passport with a CNI bearing an expired validity date (even if the latter is considered by the French authorities to be still valid). 

Since 15/01/2017, minors unaccompanied by their legal representative again need an authorization to leave the territory (AST). The AST has a specific format (Cerfa form n°15646*01 available on the site www.service-public.fr). Only the signature of a holder of parental authority is required. The AST cannot exceed the duration of one year. This AST does not eliminate the need for the minor to be provided (in addition to the signed AST and the copy of the identity document of the signatory of the AST) of his CNI or his passport or even a visa depending on the country of destination. Thus, it is strongly advised to inquire beforehand about the documents required by the country of destination by consulting the country files of the site www.diplomatie.gouv.fr  

Similarly, if the child is traveling with only one parent, some countries may require proof that the other parent authorizes this trip. For all destinations requiring a passport, a minor, regardless of age, must now have their own passport. However, minors already registered on the valid passport of their legal representative and provided that they are under the age of 15, do not need their own passport except to travel to the United States. or transit through the United States. 
The child registered on the passport of an adult can only travel accompanied by the adult holder of the passport on which he appears. The family book is not an identity document, including for national flights. It is imperative (wife, child) that the name appearing on the passport or identity document is identical to the name under which the order was made and the transport and residence documents issued.
Completion of the formalities remains, in all cases, the responsibility of the User. The costs of issuing passports, visas and other travel documents (tickets or redemption of tickets) cannot, under any circumstances, be reimbursed.
Some companies accept pets; in this case you must be in possession of their up-to-date vaccination record.
French nationals wishing to travel (including transit and correspondence) to the United States and holders of an electronic passport or a French machine-readable passport issued before October 26, 2005 are likely to benefit from the Exemption Program from Visa for a stay of up to 90 (ninety) days. They must have a return ticket. 

In all other cases, passengers must be in possession of a visa. Please note that visa delivery times can take several weeks. In any case, check with the United States Embassy in France (amb-usa.fr). 

NB: since January 12, 2009, travelers wishing to travel to the United States or in transit via the United States under the Visa Waiver Program are now subject to additional security check conditions and must request , at least 72 hours before their departure, a pre-authorization using the following process: fill out a request on the official website https://esta.cbp.dhs.gov 

Reminder: the documents required, in particular to be exempted from a visa, depend on the date of issue or renewal of the passport. You can refer to the information on the aforementioned website, which also specifies the list of countries participating in the Visa Waiver Program. 

In any case, we recommend that the User, whatever his nationality, regularly consult all the information on the countries of destination on the site http://www.diplomatie.gouv.fr/conseils-aux-voyageurs /last-minutes, in order to know the updated recommendations of the Ministry of Foreign Affairs.
 

6.2 Health risks
For any information concerning the health risks possibly present in the country(ies) of destination, and the countries of stopovers and transits and of the User's journey, as well as the recommendations issued by the authorities in the matter and to comply to its latest, the User will find the necessary information by consulting the following various websites:
• Ministry of Foreign Affairs: www.diplomatie.gouv.fr/fr/conseils-aux-voyageurs  and more particularly the “country risk” and “health” sub-headings
• Ministry of Health: https://solidarites-sante.gouv.fr/
• Health Watch Institute:  www.invs.sante.fr
• World Health Organization (WHO): www.who.int 

If you are traveling within the European Union (hereinafter "EU"), it is recommended that you obtain the European Health Insurance Card (free) which, in the 28 EU Member States, Iceland, Liechtenstein, Norway and Switzerland, will allow you to have the same access to public health care (eg doctor, pharmacy, hospital) as nationals of the country you are visiting. If this health care is paid for, you will be reimbursed after your return to your country of origin on the basis of French rates by the health insurance institutions. France is linked with other countries by international or bilateral social security agreements allowing you to be reimbursed on the basis of the French rates for treatment received abroad; for more information visit the website www.cleiss.fr

Furthermore, due to the risk of introducing diseases into the EU, the import of personal non-commercial packages of animal products into the EU is subject to strict procedures in application of a European regulation of March 5, 2009. However, these procedures do not apply to the movement of animal products between the 28 EU Member States or to animal products from Andorra, Liechtenstein, Norway, Saint-Martin and from Switzerland or, depending on the type of product, from Croatia, the Faroe Islands, Greenland or Iceland. 

All affected animal products that do not comply with these rules must be handed over on arrival in the EU for official disposal. Failure to declare these products is liable to a fine or criminal prosecution. For more information, you can consult the website of la European Commission 

7. AIR TRANSPORT SERVICES

7.1 Responsibilities:
The responsibility of LE CARRE DES AS cannot replace that of French or foreign carriers providing the transport or transfer of passengers and luggage. Under no circumstances can LE CARRE DES AS be held liable for circumstances of force majeure, for third parties unrelated to the provision of the planned services or for poor performance for circumstances attributable to the User._cc781905-5cde -3194-bb3b-136bad5cf58d_

It is specified that in terms of air transport on the IATA company, in accordance with IATA rules, LE CARRE DES AS acts as an agent of the airline which remains solely responsible for the execution of the transport. 

In terms of scheduled or chartered flights on non-IATA companies (Low Cost in particular), LE CARRE DES AS acts on request and on behalf of the Customer for whom it is the representative, the transport remaining the sole responsibility of the airline. Similarly, the railway and maritime companies remain solely responsible for carrying out the transport. 

In all cases, the liability of the airlines, as well as that of their representatives, agents or employees, is limited in the event of damage, complaints or claims, strictly to the air transport of passengers and their luggage as specified on the ticket. aircraft, the only contract between the company and the passenger. The User should consult the website of the airline concerned. 

The consequences of accidents or incidents that may occur during the performance of air transport are governed by the provisions of the Montreal Convention of May 28, 1999 or the modified Warsaw Convention of October 12, 1929 or local regulations governing transport according to the law of the country concerned. 

The User's attention is drawn to the need to provide a sufficiently long period taking into account possible delays in the event of an order on the Site for a journey including a connection or a transit, in particular when the latter includes a change of airport. We recommend that Users allow a minimum connection time of four hours. 

Customers who have booked flights at a typological rate (family, young people, babies, couples, seniors, etc.) must provide supporting documents that may be requested from them during check-in.
7.2 Plane tickets:
Plane tickets will be issued after full payment of the price. They will be issued in the form of electronic tickets (ie a non-materialized ticket), except for airlines not eligible for this type of ticket. In the latter case, the materialized ticket is sent as soon as payment is received by post or by special courier depending on the delivery method chosen by the User when ordering. For orders within 7 (seven) days of departure, delivery by Chronopost is mandatory. Delivery costs are the responsibility of the User and are indicated when ordering. 

LE CARRE DES AS cannot be held liable for any failure to deliver due to these services and/or erroneous information provided by the User as to his name and/or address. It is up to the User to contact customer service at the telephone number 06.14.55.12.05. In the event of cancellation, the User will be reimbursed in accordance with the general conditions of sale of the airline concerned. 

7.3 Baggage:
Items covered by the IATA international regulations on hazardous materials and in particular explosive, flammable, corrosive, oxidizing, irritating, toxic or radioactive items, compressed gases and objects or products not authorized by the States or making subject to restrictions such as liquids contained in cabin baggage.
LE CARRE DES AS cannot be held responsible for any refusal of boarding or confiscation of an object deemed dangerous by the company or the airport authorities.
It is up to Users to check with the airline on which they have planned to travel in order to find out about their policy on unauthorized items in baggage and in any case to carefully read the conditions of the contract of carriage. which appear on the back of the plane ticket.

LE CARRE DES AS cannot be held responsible if the company refuses to carry luggage. LE CARRE DES AS will not be able to cover any costs whatsoever if for this reason a passenger is refused boarding of his luggage. 

Cabin Baggage: Each company has its own policy. Most often, only one piece of cabin baggage is allowed per passenger whose total dimensions (circumference) do not exceed 115 cm (width + length + height = 115 cm) and whose total weight does not exceed 10 Kg. This maximum weight and size can be modified according to the type of device. In any case, this baggage remains the responsibility of the User for the duration of the trip. 

Hold baggage: Each company has its own policy. Most frequently there is a baggage allowance of 15 kg per passenger on charter flights and a baggage allowance of 20 kg per passenger on scheduled flights (economy class). To the United States, the allowance is generally expressed in number of pieces of baggage. In case of excess, if authorized, the passenger will have to pay a supplement to the airline at the airport. In general, Low Cost companies do not apply a franchise and charge a supplement for each piece of checked baggage. Companies generally charge extra for oversized luggage such as surfboards, windsurfers, bicycles, golf bags... 

We invite you to inquire with the company on which you plan to travel in order to find out about their policy on excess baggage. 

If your checked baggage is lost, damaged or delayed, the airline may be required to pay you compensation. Your complaint must imperatively respect a certain deadline, specified in the conditions of sale of the airline. 
7.4 Overbooking:
Sometimes passengers who have booked a flight do not show up for boarding. To remedy this problem of "no-shows", airlines practice overbooking or "overbooking". It may therefore happen that the number of seats available is not sufficient to accommodate all the passengers who present themselves for boarding. In this case, some passengers cannot take the scheduled flight. 

European Regulation n°261/2004 of February 11, 2004 allows you, in the event of a delay of more than two hours, cancellation or overbooking of your flight, to obtain from the air carrier support, reimbursement and/or or compensation, whether your flight is scheduled, charter, "only" or included in a package. We invite you to consult the notice in the boarding area informing you of your rights in this regard. In the event of a complaint, a notice setting out your rights to compensation will be given to you by the airline. LE CARRE DES AS cannot be held responsible in the event of overbooking. 

7.5 Children:
Minor children must in principle travel accompanied by a responsible adult.
However, certain companies may accept, depending on the type of flight (connections or not), that minors may, depending on their age, travel unaccompanied ("unaccompanied minors"), by laying down certain conditions or by requesting the completion of certain formalities, in particular at the airport. We therefore recommend that you contact the airline concerned beforehand in order to find out the conditions of transport for minors. 

Children under 2 years old do not have a seat on the plane unless the parents have ordered and paid for a ticket at the child rate especially for them. The User's attention is drawn to the fact that this provision is only valid on the condition that the children are under 2 years old throughout the duration of the trip, on the date of departure and on the date of return. . Indeed, the airlines consider that children over the age of 2 on the date of return must take a return ticket at the child rate. Costs incurred by failure to comply with this rule cannot be reimbursed. 

It is recalled that airlines sometimes refuse boarding to pregnant women, when they believe that due to the end of the pregnancy, a risk of premature delivery during transport is possible.
7.6 Meal: 
Generally, charter flights do not offer special meals. On scheduled flights, inquire directly with the company on which you plan to travel.
On the flights of Low Cost airlines, the services on board, in particular drinks and catering, are generally chargeable; in some cases they are very small.

7.7 Registration:
In general, passengers must present themselves at the airport counter 3 hours before take-off. It is up to the User to check with the airline the check-in deadline beyond which passenger check-in is no longer accepted. Please note: disabled people, passengers with oversized baggage or excess baggage must contact the airline beforehand to check the check-in deadline. LE CARRE DES AS cannot be held responsible and cannot bear any costs whatsoever, nor the refund of the unused ticket if a passenger is refused check-in for presentation beyond the check-in deadline. . 

7.8 Identity of the carrier:
In the case of commercial agreements between scheduled airlines known as "Code sharing", it is possible that the User makes the trip, in whole or in part, with another airline than the one stipulated on the ticket. plane without giving right to any tariff readjustment and/or compensation. 

LE CARRE DES AS cannot be held responsible for these changes. In accordance with Articles R 332-3 to R 322-6 of the Civil Aviation Code, LE CARRE DES AS informs the User for each section of the flight of the identity of the contractual carrier and, where applicable, of the actual carrier liable to carry out the transport(s). 7.9 Loss or theft of ticket: If you are the victim of a loss or theft of your ticket during your trip, you must make a specific declaration to the police and the airline and insure your return at your own expense. by purchasing another ticket from the issuing company. All consequences arising from the loss or theft of a ticket are your responsibility.

7.10 Charter Flights/Charters/Low Cost:
In the case of special or charter flights, the identity of the air carrier, flight schedules, types of aircraft, itinerary and stopovers are communicated for information on the outward and return journeys. They can be subject to modifications, be delayed up to 24 hours, even after confirmation. European Regulation n°261/2004 of February 11, 2004 allows you, in the event of a delay of more than two hours, cancellation or overbooking of your flight, to obtain from the air carrier support, reimbursement and/or or compensation, whether your flight is scheduled, charter, "only" or included in a package. 

Airports: When the town or place of arrival or departure has several airports, the carrier can take off/land at any one or the other. For example in Paris the carrier may have to land at Orly or Roissy Charles de Gaulle. On certain sections, Low Cost companies use certain airports far from the main towns. 

7.11 Miscellaneous Provisions:
Any seat not used on the outward and/or return journey, for any reason whatsoever, cannot be reimbursed. LE CARRE DES AS cannot be held responsible for delays occurring beyond its control (intensity of air traffic, strikes, attacks, technical or other incidents). 

Any trip interrupted, shortened or any service not consumed by the User will not give the right to any refund, in particular any plane seat on the outward and return journey. 

On scheduled flights, all sections must be used otherwise the airline reserves the right to readjust the fare or cancel the seats. 

7.12 Cancellation and change fees:
Canceling or modifying your reservation incurs a fee. The User will be reimbursed in accordance with the general conditions of sale of the airline on which he has planned to travel. 

7.13 Reimbursement of air taxes:
Article L 113-8 of the Consumer Code specifies that air carriers and natural or legal persons marketing air transport tickets must reimburse the air taxes which are due from the actual boarding of the passenger, when the ticket transport is no longer valid and has not given rise to transport. The refund must be made within 30 (thirty) days from the date of receipt of the refund request made by the customer. It is free when the application is filed online. Fees may be charged to the customer when his request is not made online, up to a maximum of 20% of the amount reimbursed. 7.14 Security measures
Given the security measures taken by a number of States and/or airlines relating to air transport, we recommend that you check with the airline concerned beforehand. This is particularly the case for electronic devices (laptops, tablets, smartphones, etc.) for which certain States and/or companies (United States, United Kingdom in particular) require that they be charged before boarding the airplane. Otherwise, if they are unloaded, they risk being confiscated or not being allowed on board by the authorities. 

In addition, we inform you that the US Transportation Security Administration (TSA) may check each piece of baggage (in the hold or in the cabin) before it is allowed on planes leaving US airports. Although most bags are electronically checked, some are opened for manual checking. If the bag is closed with a lock/padlock not approved by the TSA, the latter is authorized to force it to open the bag, notwithstanding the risk of damage to the closure and the bag. 8. ACCOMMODATION SERVICES

8.1 Length of stay: Prices are calculated based on a number of nights and not days. Per night is understood to mean the period of availability of the rooms. This varies from 2 p.m. to 6 p.m. on the day of arrival, until 12 p.m. the next day. 

If, in the event of late arrival or early departure, the first and/or last night is shortened, no refund or compensation may be granted. It is strongly recommended to inform the hotel in case of late arrival (after 7:00 p.m.), especially during school holidays or bridges (long weekends). 

8.2 Voucher: After full payment, the User will be given a voucher (“Voucher”), in the form of an electronic voucher sent by e-mail. Only the Services explicitly mentioned on the voucher are included. It is therefore up to you to check the information on the voucher. 

The User must return the voucher to the hotel reception on the day of his arrival; failing this, he will have to pay the price of the room to the hotelier without being able to claim reimbursement of the exchange voucher not presented. 

8.3 Room: The rooms are made available between 2 p.m. and 6 p.m. on the day of arrival and must be vacated before 12 noon on the day of departure.

8.6 Thefts, valuables and losses
It is strongly recommended not to bring valuables (jewellery, etc.) but only necessary and appropriate effects for the purpose and specific conditions of the trip. LE CARRE DES AS is not responsible for thefts committed in hotels. It is recommended that Users deposit valuables, identity papers and transport tickets in the hotel safe. 

The User is responsible for the forgetting or loss of objects occurring in particular during transport or transfers. It is also inadvisable to leave in the baggage entrusted to carriers all identity papers, essential medicines, valuables, cash, cameras, camcorders […]. The User can establish a declaration of values when registering. 

9. TOURIST PACKAGES

9.1 The description of the product appearing on the LE CARRE DES AS website and the summary of your order, supplemented by the provisions of these conditions of sale, constitute the prior information provided for by article R 211-4 of the Tourism Code. In the event of non-compliance with the information obligation provided for in article R 211-4 13° of the Tourism Code and relating to the identity of the carrier(s) and in particular the actual carrier, the customer may terminate the contract. of sale and obtain the refund without penalties of the sums paid.

10. TRAVELMAKER TAILOR-MADE TRIPS

10.1 Service fees
Any order entails the collection by LE CARRE DES AS of service fees, which vary according to the type of Services requested and expressed by file, which are added to the price of the Services ordered. In case of cancellation, service fees are not refundable. 

10.2 Payment
For tailor-made travel orders, the User can:
• either pay cash at the time of the order (no discount is applicable)
• or, for orders made more than 35 days before departure, the User has the option of paying a deposit. 

For a reservation of a trip more than 35 days before departure, the User must pay:
• 100% of the amount of the air transport
• At least 30% down payment of the amount of land Services
• The balance no later than 35 days before the departure date. 

For any type of trip, when the trip is booked within 35 days of departure; the User will have to pay:
• the full price of the trip when booking 

Exceptions related to certain products, destinations, time of year:
On certain products, destinations, or depending on the time of year, hotels and/or local service providers may charge us 100% cancellation fees as soon as the reservation is firm. We will be obliged to demand the immediate payment of 100% of the amount of the trip regardless of the departure date.
It is up to the customer to pay the balance by calling 06.14.55.12.05.
Failure to pay the balance within the time limit is likely to result in the cancellation of the order by the customer, the latter remaining liable for the cancellation costs.
In any case, the remittance of a credit card number is not considered as discharge from the debt until the agreement of the payment center is obtained. 

10.3 Cancellation and change fees
Any request for cancellation or modification will incur costs according to the scale below (subject to specific mentions in the description of the product chosen), the scale of deduction is upon receipt of the mail:  

- From 45 to 30 days before departure: 25% of the trip price 

- From 30 to 21 days before departure: 50% of the price of the trip 

- From 21 to 15 days before departure: 75% of the price of the trip 

- From 15 to 08 days before departure: 90% of the price of the trip 

- Less than 08 days before departure for any reason whatsoever 100% of the travel price

For Air Services
In the case of the sale of a tailor-made trip including scheduled flights, we inform you that any modification/cancellation of your plane tickets occurring after the date of their issue will result in the application of specific modification/cancellation costs. tickets. In the event of a non-modifiable and non-refundable flight, the cancellation fees are 100% of the price of the flight. 

11. COMPLAINTS - TOURISM AND TRAVEL MEDIATION
The study of complaint files will relate only to the contractual elements of your reservation. Any failure in the performance of the contract must be noted on site, reported and justified as soon as possible, in writing, by the customer to the Service Provider concerned, as well as to LE CARRE DES AS or its representative.
The Customer is required to report any non-compliance observed on site as soon as possible in view of the circumstances of the case. In this respect, LE CARRE DES AS recommends that customers report and have the local representative record on site in writing any failure in the performance of the contract. 12. RAIL TRANSPORT SERVICE
Rail transport Services are offered either as part of a tourist package, or alone. 

Applicable supply and performance conditions: The rail transport Services will be provided exclusively by the rail carrier under its sole responsibility. It is recalled that changes may occur between the date the photograph or illustration was taken and the date of the User's stay. 

16. PROOF
It is expressly agreed that, unless there is a manifest error on the part of the Partners or LE CARRE DES AS, of which the User provides proof, the data stored in the information system of LE CARRE DES AS and/or its Partners has the force conclusive as to the orders placed by the User.

16. NO RIGHT OF WITHDRAWAL

Travelers are provided with an emergency telephone number or contact point details to reach the service provider or retailer. Travelers may transfer their travel service to another person, subject to reasonable notice and possibly subject to the payment of additional fees. The price of the travel service can only be increased if specific costs increase and if this possibility is explicitly provided for in the contract, and in any case cannot be changed less than twenty days before the start of the trip. If the price increase exceeds 8% of the price of the travel service, the traveler can terminate the contract. If the service provider reserves the right to increase the price, the traveler is entitled to a price reduction in the event of a decrease in the corresponding costs. Travelers can rescind the contract without paying a rescission fee and be fully reimbursed for payments made if one of the essential elements of the contract, other than the price, undergoes a material change. If, before the start of the service, the responsible professional cancels it, travelers can obtain reimbursement and compensation, if applicable. Travelers can terminate the contract without paying termination fees before the start of the service in the event of exceptional circumstances, for example if there are serious security problems at the place of destination which are likely to affect the trip. In addition, travelers may, at any time before the start of the trip, terminate the contract upon payment of an appropriate and justifiable termination fee. If, after the start of the trip, important elements of the trip cannot be provided as planned, other appropriate services must be offered to the travellers, at no additional cost. Travelers can rescind the contract without paying a rescission fee when the services are not performed in accordance with the contract, this significantly disrupts the performance of the trip and the service provider does not remedy the problem. Travelers are also entitled to a price reduction and/or compensation in the event of non-performance or poor performance of the travel service. The service provider or retailer must provide assistance if the traveler is in difficulty. If the service provider or retailer becomes insolvent, the amounts paid will be refunded. LE CARRE DES AS has taken out insolvency protection with the APST. Travelers can contact this organization if they are refused services due to the insolvency of LE CARRE DES AS. 22. PROPRIETE INTELECTUELLE

22.1. Généralités :
Le Site, son contenu et tous les éléments le constituant, sont des créations pour lesquelles des sociétés du groupe LE CARRE DES AS et/ou, le cas échéant, des Partenaires, sont titulaires de l'intégralité des droits de propriété intellectuelle et/ou des droits d'exploitation, en particulier au titre du droit d'auteur, du droit des bases de données, du droit des marques, et du droit des dessins et modèles, des photos. polaris inc. est une marque déposée et est propriétaire des photos utilisées à titre publicitaire. Les photos utilisées par ailleurs sont réputées  être libres de droits. Les photos avec copyrights sont indiquées.  
Le Site, ainsi que les logiciels, bases de données, textes, informations, analyses, images, photographies, graphismes, logos, sons ou toutes autres données contenues sur le Site demeurent la propriété exclusive de sociétés du groupe LE CARRE DES AS et/ou des Partenaires ou, le cas échéant, de leurs propriétaires respectifs avec qui ces derniers ont passé des accords d'utilisation.
Il est concédé à l'Utilisateur un droit d'utilisation non-exclusif, non transférable et dans un cadre privé, du Site et des données contenues sur le Site. Le droit ainsi concédé consiste en (i) un droit de consulter en ligne les données et informations contenues sur le Site et (ii) un droit de reproduction consistant en une impression et/ou une sauvegarde des données et informations consultées.
Ce droit d'utilisation s'entend uniquement pour un usage strictement privé. 
Toute autre utilisation du Site, notamment commerciale, de la part de l'Utilisateur est interdite. 
L'Utilisateur s'interdit notamment, de manière non exhaustive, de reproduire et/ou représenter pour un usage autre que privé, vendre, distribuer, émettre, traduire, adapter, diffuser et communiquer intégralement ou partiellement sous quelque forme que ce soit tout élément, informations ou données du Site.
En outre, l'Utilisateur s'interdit d'introduire, par quelque moyen que ce soit, des données susceptibles de modifier ou porter atteinte au contenu ou la présentation du Site.
Tout lien hypertexte avec le Site, quel que soit le type de lien, doit faire l'objet d'une autorisation préalable de LE CARRE DES AS, sur support papier ou électronique.

23. DROIT APPLICABLE
Les conditions de vente sont soumises au droit français. Tout litige relatif à leur interprétation et/ou à leur exécution relève des tribunaux français. L’Utilisateur peut saisir à son choix, outre l'une des juridictions territorialement compétentes, la juridiction du lieu où il demeurait au moment de la conclusion du contrat ou de la survenance du fait dommageable. 

24. FORMULAIRES D’INFORMATION STANDARD  

24.1 Formulaire d'information standard pour les contrats de voyage à forfait
La combinaison de services de voyage qui vous est proposée est un forfait au sens de la directive (UE) 2015/2302 et de l'article L.211-2 II du code du tourisme. Vous bénéficierez donc de tous les droits octroyés par l'Union européenne applicables aux forfaits, tels que transposés dans le code du tourisme. 
LE CARRE DES AS sera entièrement responsable de la bonne exécution du forfait dans son ensemble. En outre, comme l'exige la loi, LE CARRE DES AS dispose d'une protection af
in de rembourser vos paiements et, si le transport est compris dans le forfait, d'assurer votre rapatriement au cas où elle deviendrait insolvable (s). Pour plus d'informations sur les droits essentiels au titre de la directive (UE) 2015/2302 [voir ci-dessous]. 
Droits essentiels au titre de la directive (UE) 2015/2302 transposée dans le code du tourisme : Les voyageurs recevront toutes les informations essentielles sur le forfait avant de conclure le contrat de voyage à forfait. L'organisateur ainsi que le détaillant sont responsables de la bonne exécution de tous les services de voyage compris dans le contrat. Les voyageurs reçoivent un numéro de téléphone d'urgence ou les coordonnées d'un point de contact leur permettant de joindre l'organisateur ou le détaillant. Les voyageurs peuvent céder leur forfait à une autre personne, moyennant un préavis raisonnable et éventuellement sous réserve de payer des frais supplémentaires. Le prix du forfait ne peut être augmenté que si des coûts spécifiques augmentent (par exemple, les prix des carburants) et si cette possibilité est explicitement prévue dans le contrat, et ne peut en tout cas pas être modifié moins de vingt jours avant le début du forfait. Si la majoration de prix dépasse 8 % du prix du forfait, le voyageur peut résoudre le contrat. Si l'organisateur se réserve le droit d'augmenter le prix, le voyageur a droit à une réduction de prix en cas de diminution des coûts correspondants. Les voyageurs peuvent résoudre le contrat sans payer de frais de résolution et être intégralement remboursés des paiements effectués si l'un des éléments essentiels du forfait, autre que le prix, subit une modification importante. Si, avant le début du forfait, le professionnel responsable du forfait annule celui-ci, les voyageurs ont le droit d'obtenir le remboursement et un dédommagement, s'il y a lieu. Les voyageurs peuvent résoudre le contrat sans payer de frais de résolution avant le début du forfait en cas de circonstances exceptionnelles, par exemple s'il existe des problèmes graves pour la sécurité au lieu de destination qui sont susceptibles d'affecter le forfait. En outre, les voyageurs peuvent, à tout moment avant le début du forfait, résoudre le contrat moyennant le paiement de frais de résolution appropriés et justifiables. Si, après le début du forfait, des éléments importants de celui-ci ne peuvent pas être fournis comme prévu, d'autres prestations appropriées devront être proposées aux voyageurs, sans supplément de prix. Les voyageurs peuvent résoudre le contrat sans payer de frais de résolution lorsque les services ne sont pas exécutés conformément au contrat, que cela perturbe considérablement l'exécution du forfait et que l'organisateur ne remédie pas au problème. Les voyageurs ont aussi droit à une réduction de prix et/ou à un dédommagement en cas d'inexécution ou de mauvaise exécution des services de voyage. L'organisateur ou le détaillant doit apporter une aide si le voyageur est en difficulté. Si l'organisateur ou le détaillant devient insolvable, les montants versés seront remboursés. Si l'organisateur ou le détaillant devient insolvable après le début du forfait et si le transport est compris dans le forfait, le rapatriement des voyageurs est garanti. LE CARRE DES AS a souscrit une protection contre l'insolvabilité auprès de l’APST. Les voyageurs peuvent prendre contact avec cette entité (15 avenue Carnot - 75017 Paris ; info@apst.travel, 01 44 09 25 35 / 01 44 09 88 00) si des services leur sont refusés en raison de l'insolvabilité de LE CARRE DES AS.

25.Boutique : Les articles sont vendus prix TTC et réservés en expédition à la France métropolitaine. Les prix s'entendent hors frais d'expédition à calculer en fonction du choix du client qui est invité a finaliser sa commande par téléphone aux horaires de l'agence du mardi au samedi de 09h à 18h sur le 0642882734 ou au 0482629586.
